These Terms of Service ("Terms") govern your use of this website and any purchase you make from Fares Halout Photography ("we," "us," "our"). By placing an order or using this site, you agree to these Terms. Please also review our Privacy Policy, Refund Policy, and Shipping Policy, which form part of these Terms.

About Our Products

Every print sold through this site is a fine art photograph captured, edited, and produced by Fares Halout. Prints are made to order in the size, material, and finish you select at checkout, through a professional print lab. Because of this, colours, framing, and finish may vary slightly from what is displayed on screen due to differences in monitor calibration.

Copyright and Intellectual Property

All photographs, images, and artwork on this site remain the exclusive intellectual property of Fares Halout. When you purchase a print, you are purchasing a physical, tangible copy of the artwork for personal display only. You are not purchasing the copyright, the digital image file, or any right to reproduce, scan, photograph, publish, sell, or otherwise distribute the image in any form, physical or digital, without our prior written consent. Unauthorised reproduction is a breach of copyright law and these Terms.

Limited Edition and One of One Pieces

Where a piece is sold as a Limited Edition, only the stated number of prints of that image, in that size and material combination, will ever be produced and numbered. One of One pieces are unique and will not be reproduced in that exact size and material again. Each Limited Edition and One of One print is accompanied by a hand-signed Certificate of Authenticity.

Pricing and Availability

All prices are listed in Australian Dollars (AUD) and include GST where applicable. We reserve the right to change prices, correct pricing errors, and update product availability at any time without notice. In the event a pricing error is identified after an order is placed, we will contact you before processing the order to confirm the correct price or offer a full refund.

Orders and Payment

By placing an order, you confirm that all information provided is accurate and complete. We accept payment via the methods shown at checkout. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or production capacity issues, in which case you will be refunded in full.

Production and Shipping

As each piece is made to order, please refer to our Shipping Policy for current production and delivery timeframes. We currently ship within Australia only.

Returns and Refunds

Limitation of Liability

To the maximum extent permitted by law, Fares Halout Photography will not be liable for any indirect, incidental, or consequential loss arising from your use of this site or your purchase of a product. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Website Use

You agree not to misuse this site, including attempting to reproduce, scrape, or redistribute our images or content, interfere with the site's operation, or use the site for any unlawful purpose.

Changes to These Terms

We may update these Terms from time to time. Changes take effect once posted to this page. Your continued use of the site after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
